Florida Bar Board Approves Lawyer Web Site Rules

The Florida Bar Board of Governers has given final approval for an advertising rule amendment regulating attorney and law firm web sites.

Summary:

• Web Site home pages must comply with all Bar advertising regulations, except the requirement that it be submitted to the Bar for review.
• Inside pages (accessed by the viewer taking a definite action) are deemed request for further information.  These will be exempt from other ad regulations, including:
• Internal pages may contain factually verifiable statements concerning past results obtained by the lawyer or law firm, so long as they do not mislead.
• Internal pages may contain testimonials obtained by the lawyer or law firm, so long as they do not mislead.
• Internal pages may contain text characterizing quality of legal service, so long as the text is factually verifiable and do not mislead

What does this mean?  In general, make sure your home page complies with all Florida Advertising rules.  Your inside pages can contain testimonials, past results and talk about your quality of legal service, so long as it does not mislead and contains a disclaimer.

More information to come, once the Florida Supreme Court approves the rules.

Copyright Infringement - MVI Solutions of Fort Lauderdale

It seems team PaperStreet was hit with another copyright infringement. This time a local Fort Lauderdale web design company decided to copy one of our designs for the Simmons Law Firm, LLC.

As you will see, the overall theme, colors, fonts, graphics, contact form, and other code were taken directly from our client’s web site. You may notice that the logo is different on the current site. Well it is now, but in our original July 2004 design, the logo was separated into two parts, just like MVI’s design.

To all web designers out there, you should protect your work with a actual copyright registration with the US Copyright Office as soon as the work is published. If you obtain a copyright registration within the first three months of publishing the work, the registration gives you proof and more importantly it gives you the right to attorneys fees and statutory damages. However, even without a copyright registration you still have copyright rights, so long as you can document that your work was published first. In this case, I found an email dating back to 2004 with the client approving the new design. So save everything, as you never know when it will come in handy.

UPDATE: MVI Solutions has agreed to redesign the web site, should have it done in a week.

PaperStreet is delighted to announce that the new site for The Shane McGee Foundation is now live. The web site is a very accessible and elegant product information portal for all conscientious consumers. Click below to see it for yourself.

The Shane McGee Foundation was formed by the McGee family, to honor their son, Shane, who died in a preventable automobile fuel-fed fire. This tragedy and subsequent Wrongful Death and Catastrophic Injury trial was chronicled in the media, including the television news show, 60 Minutes. While the accident was tragic and needless, it did ultimately result in visibility into this issue, as well as improving automotive design to prevent these types of fires. The Shane McGee Foundation was formed in the belief that losing one person to unsafe products is too high of a price to pay.

The Shane McGee Foundation is a 501(c)3 Private Operating Foundation incorporated in Florida. The Foundation is self-funded by the McGees with the sole purpose of educating consumers…educating them about the proper usage of safe consumer products; about dangerous products; and about news that affects all of us and our wellbeing.
